Official wording

For the purposes of subregulation 1.11B(1) of the Regulations, a passport is an ETA-eligible passport in relation to an application for a visa if in the table in Schedule 1: … Passport issued by the authorities of Taiwan … Passport must not purport to be: (a)  an official passport; or (b)  a diplomatic passport; or (c)  a Taiwanese “compatriot” document.

The Migration Act 1958 s.42 creates the obligation at the root of this regime — a non-citizen must not travel to Australia without a visa that is in effect — and s.32 creates the special category visa for New Zealand citizens. The Migration Regulations 1994 and the ministerial instruments made under them (IMMI 18/084, LIN 23/064) then prescribe who may use the streamlined visa routes.

The instrument lists passports issued by the authorities of Taiwan as ETA-eligible subject to the stated condition; a holder of an ordinary (non-official, non-diplomatic, non-compatriot) Taiwanese passport may therefore apply online for the Subclass 601 ETA, with the 3-month stay set by clause 601.511.

  • Visa-free, 90 days

    Holder of a valid APEC Business Travel Card (ABTC) that carries Australia's pre-clearance — 'AUS' printed on the reverse of the physical card, or 'AUS' visible on the Virtual ABTC home screen — may enter Australia without applying for a visa.

    The passport number linked to the physical or Virtual ABTC must match the passport number used to travel to Australia.

    The card may not be used to work in Australia; paid employment, being remunerated for services to an Australian business or organisation, selling goods or services to the general public, and engaging in a working holiday are all excluded, and work requires a visa with work rights.
