Aevamo’s reading

Section 6(1) of the Immigration Act 2011 imposes the obligation that is the regime: every person must hold a valid visa to travel to Niue unless exempt. Section 6(2) delegates to Cabinet the power to exempt classes of persons by regulation, and the Immigration Regulations 2011 exercise that power for Schedule 2 countries; the Act is therefore the instrument that creates the obligation, not a description of it.

The Immigration Act's purpose clause confirms that New Zealand citizens other than prohibited persons have the right to travel to and remain in Niue, and s.4(5) shows the only circumstance in which a New Zealand citizen needs a visa or permit is when section 9 applies - so NZL holders need no advance authorisation and are not capped by the visitor-permit rules.
