Dahir n° 1-03-196 promulgating Loi 02-03 is the statute that imposes the obligation: Article 3 requires every foreigner arriving on Moroccan territory to hold a valid travel document "assorti, le cas échéant, du visa exigible". The visa-exemption list, e-visa note and change records all implement or modify that requirement; the Dahir creates it.

Article 1 of Loi 02-03 defines the persons it governs as "étrangers" — those not holding Moroccan nationality. A Moroccan national is therefore outside the entry-visa regime entirely, so a Moroccan passport holder enters Western Sahara (administered by Morocco) as their own territory with no visa and no stay cap.
