Commonwealth Act No. 613, the Philippine Immigration Act of 1940, creates the visa obligation: Section 10 requires every nonimmigrant to present a valid passport visa on admission and Section 50(b) makes that requirement reach every alien, defined as any person not a citizen of the Philippines. EO 408 and the DFA list are exemptions from that statutory requirement.

FSC No. 112-11, reproduced on the DFA page, grants Hong Kong SAR passport holders visa-free entry for an initial stay of fourteen days.
