Section 102 imposes the entry-permit requirement on every noncitizen and section 103(1) creates the exemptions — the universal 30-day permit-free visit and the 365-day grants for United States, Marshall Islands and Palau nationals. It is the statute that creates the obligation and the entitlement; the EU-FSM agreement is a treaty that adds a separate 90-day grant for EU member states, and the Embassy FAQ only reports practice.
The Nineteenth Congress's resolution states that the EU-FSM visa waiver agreement accords citizens of the European Union (excluding the United Kingdom and Ireland) entry and stay without a visa for up to 90 days in any 180-day period, and it records Congress's ratification of that agreement, making the 90-day grant operative in the FSM.
