Act 2026-11 s.45(2) imposes the visa requirement on nationals who need a short stay visa under Union law, and s.45(3) exempts those who do not; s.41(2) grants citizens of the Union visa-free entry for 90/180 days. It is the instrument that CREATES the obligation for Gibraltar, applying the EU lists by reference; Reg (EU) 2018/1806 supplies the lists themselves.
Article 3(1) of Regulation (EU) 2018/1806 requires nationals of the listed Annex I third countries to hold a visa to cross the external border, and s.45(2) of the Treaty on Gibraltar and the European Union Act 2026 requires those same nationals to hold a visa to enter and stay in Gibraltar.
