The Immigration Act 2006 (43 MIRC Ch.1) is the instrument that CREATES the obligation: section 112 makes a visa or exemption compulsory for every non-citizen entering the Republic, section 113 grants the statutory exemptions, and section 137 requires a visitor visa before arrival except for Cabinet-approved visa-on-arrival countries. The Regulations and the Division of Immigration's list implement that obligation.

The list places these countries in the VISA ON ARRIVAL (VOA) category for ordinary passports with a 90-day stay from the date of arrival, so their nationals need nothing arranged in advance and obtain the visitor visa on arrival.
