The Migration Act 1958 s.42 creates the obligation at the root of this regime — a non-citizen must not travel to Australia without a visa that is in effect — and s.32 creates the special category visa for New Zealand citizens. The Migration Regulations 1994 and the ministerial instruments made under them (IMMI 18/084, LIN 23/064) then prescribe who may use the streamlined visa routes.
The instrument specifies these passports as eVisitor eligible, so the holder may apply online for the Subclass 651 visa before travelling; clause 651.511 (cited in fieldSources) fixes the stay at 3 months per entry within a 12-month validity.
