5. Регистрация граждан государств одной Стороны производится на срок, не превышающий 90 календарных дней с момента пересечения государственной границы государства Стороны въезда.

Пункт 5 of the Rules imposes the obligation — immigrants enter Kazakhstan only with a Republic of Kazakhstan visa unless legislation or a ratified treaty provides otherwise — and пункты 6 and 17 create the visa-free entitlements and their durations. The Migration Law delegates the entry order to the Government, and this resolution exercises that delegation.

Article 1(5) of the Kazakhstan-Azerbaijan agreement provides that registration of citizens of either Party is issued for up to 90 calendar days from crossing the border, confirming the 90-day visa-free stay.
