Dahir n° 1-03-196 promulgating Loi 02-03 is the statute that imposes the obligation: Article 3 requires every foreigner arriving on Moroccan territory to hold a valid travel document "assorti, le cas échéant, du visa exigible". The visa-exemption list, e-visa note and change records all implement or modify that requirement; the Dahir creates it.
The Moroccan embassy in Azerbaijan is quoted announcing the visa exemption entered into force 28 August 2024, so Azerbaijani nationals travel to Morocco (hence Western Sahara) visa-free up to 90 days.
