The Kiribati Immigration Act 2019 creates the obligation: section 8 provides that persons other than Kiribati citizens must hold a visa to travel to and be in Kiribati, and section 28/62 create the waiver power. The Entry and Visa Exemption Order 2023 is the waiver instrument made under s.62(1),(2) of this Act, so the Act is the source of both the default requirement and the exemption power. The -ilo id is the same Act as a text-extractable copy hosted by ILO NATLEX.

Section 8(1) of the Immigration Act 2019 imposes the general rule that a person who is not a Kiribati citizen must hold a visa to travel to Kiribati; the two numbered routes are holding a visa or being covered by a visa waiver. The only operative waiver list is the Entry and Visa Exemption Order 2023, which names none of these issuers, so they must obtain a visa in advance.
